Order No. 46/2019 of the Rector of the Wrocław University of Environmental and Life Sciences of April 2, 2019

regarding detailed principles of training in the field of occupational health and safety (OHS) at the Wrocław University of Environmental and Life Sciences

Pursuant to Article 23 (2) (2) of the Act of July 20, 2018 – Law on Higher Education and Science (2018, item 1668, as amended), Article 2374 of the Labour Code in connection with § 2 and the following of the Order of the Minister of Economy and Labour of July 27, 2004 on training in the field of occupational safety and health (Journal of Laws No. 180, item 1860, as amended) and based on the Order of the Minister of Science and Higher Education of November 2, 2018 regarding the method of ensuring safe and hygienic working and education conditions at universities (Journal of Laws 2018 item 2090), the following is ordered:

§ 1

  1. The OSH training is conducted as: 

    1. initial training, 
    2. periodic training in the form of a briefing, a course, or a seminar.

  2. Initial training in the field of occupational health and safety is obligatory for: 

    1. znewly hired employees,
    2. PhD students,
    3. students and pupils who serve their internship at the University,
    4. volunteers.

  3. Detailed training programmes based on framework programmes contained in the Order of the Minister of Economy and Labour of July 27, 2004 (Journal of Laws No. 180, item 1860, as amended) are developed by a unit organizing the training in agreement with the Health and Safety Inspectorate.

§ 2

  1. Initial training for individual groups of workstations consists of: 

    1. general initial training referred to as a general training, 
    2. initial training at the workplace referred to as an on-the-job training.

§ 3

  1. General training is provided before an employment or internship begins for: 

    1. newly employed employees, 
    2. students who serve their internships at the University, 
    3. students who serve their apprenticeship at the University.

  2. General training is provided by employees of the Health and Safety Inspectorate.

§ 4

  1. On-the-job training is provided before an employment or internship begins, directly at the workplace, for: 

    1. blue-collar workers,
    2. employees exposed to factors harmful to their health, onerous or dangerous, 
    3. employees transferred to positions where they are exposed to factors harmful to their health, onerous or dangerous, 
    4. students and pupils who serve their internships at the University, 
    5. PhD students pursuing PhD at the University,
    6. volunteers providing work for the University.

  2. On-the-job training is provided by an employees’ supervisor or a designated person having professional experience and knowledge of the specificity of threats at a given workplace.

  3. The fact that an employee completed the general and on-the-job training should be confirmed by him/her in writing and recorded in the employee’s personal file.

§ 5

  1. Periodic training to consolidate knowledge in the field of occupational health and safety is provided for: 

    1. employees in managerial positions (every 5 years), 
    2. academic teachers, PhD students, engineers and technical employees (every 5 years), 
    3. blue-collar workers (briefing every 3 years).

  2. The duration of training for employees in individual positions is specified in the detailed training programmes referred to in § 1 (3).

§ 6

  1. The first periodic training for blue-collar workers is provided within 6 months since they started working.
  2. The first periodic training for employees in the remaining positions is provided within 12 months since they started working in these positions.

§ 7

  1. Periodic training should end with an exam that checks how much knowledge covered by the training programme has been assimilated.
  2. The certificate of the periodic training completion should be kept in the employee’s personal files.

§ 8

The execution of the Order is supervised by deans and heads of organizational units, respectively, in cooperation with the Health and Safety Inspectorate.

§ 9

Once this Order becomes effective, the Rector’s Order No. 74/2005 of August 29, 2005 regarding detailed principles of training in the field of occupational health and safety (OHS) for employees of the Agricultural University in Wrocław shall no longer apply.

§ 10

The Order becomes effective on the day of its signature.
